Section 844.27 - Jurisdiction(a) The Agency may exercise jurisdiction over complaints under this chapter in which: (1) the work was performed or would have been performed in Texas; and:(2) the employer: (A) is a resident employer; or(B) is a non-resident employer pursuant to the Texas Civil Practice & Remedies Code, Chapter 17, Subchapter C, also known as the "Texas Long-Arm Statute," when the following are met: (i) the employer employs the complainant in Texas at the time of the adverse action or the employer's contact with Texas is continuing and systematic; and(ii) exercising jurisdiction is consistent with: (I) fair play and justice as determined by the quality, nature, and extent of the employer's activities in Texas including the extent to which the employer avails itself of the benefits and protections of Texas law; and(II) the relative convenience of the parties.(b) The Agency shall not exercise jurisdiction over complaints based on work performed or intended to be performed outside the United States.40 Tex.
