Section 840.20 - Initial Eligibility Consideration(a) All training programs that have not previously been determined eligible for the statewide ETPL shall submit such eligibility criteria and performance information required by the Agency. This information shall be submitted in a manner determined by the Agency.(b) Eligibility criteria shall include: (1) a connection to statewide targeted occupations;(2) a partnership with businesses in Texas, in accordance with Agency guidance; and(3) other criteria required by the Commission.(c) Performance information shall include such requirements as determined necessary by the Agency.(d) The Agency may exempt a program from the performance information requirement for initial eligibility determination. Such exemption may be applied when a program has not been connected to any students or when such connection is of insufficient duration to calculate performance.(e) The Commission may determine minimum performance targets for initial eligibility for the statewide ETPL.(f) Boards and the Agency shall review program eligibility criteria and aggregated performance information submitted by training programs in order to determine eligibility.(g) Training programs determined eligible under this subchapter shall be approved for inclusion on the statewide ETPL for up to 12 months following approval by the Agency.(h) Following the initial eligibility period, training programs shall be subject to continued eligibility determination.40 Tex.
