Section 9.32 - DefinitionsThe following words and terms, when used in this subchapter, shall have the following meanings, unless the context clearly indicates otherwise.
(1) Administrative law judge--The attorney designated or appointed by the commissioner to conduct and preside over the administrative hearing.(2) Adverse action--Any action taken or proposed by the department against a provider in which the provider may request an administrative hearing under Chapter 406 of this title (relating to ICF/MR Programs) or this chapter, concerning Medicaid Programs.(3) Commissioner--The commissioner of the Texas Department of Mental Health and Mental Retardation.(4) Days--Calendar days, unless otherwise specified.(5) Department--The Texas Department of Mental Health and Mental Retardation (TXMHMR) or its designee.(6) Person--An individual, partnership, corporation, association, governmental subdivision or agency, or a public or private organization of any character.(7) Provider--Any person with whom the department has a provider agreement.(8) Provider agreement--Any written agreement that obligates the department to pay money to a person for goods or services under the Title XIX Medical Assistance Program.40 Tex.
