If an award and payment is made from the Fund and the licensee, or person required to be licensed, fails to reimburse and/or fails to agree in writing to reimburse the Fund and/or the complaining party to the case in accordance with the provisions of this chapter, the department shall initiate proceedings, after 90 days of failure to reimburse and/or failure to agree in writing to reimburse the Produce Recovery Fund, to cancel the licensee's license in accordance with the Texas Agriculture Code, § RSA 103.009. Such proceedings shall be conducted in accordance with the Texas Agriculture Code, § RSA 12.032, the Administrative Procedure Act, Texas Government Code, Chapter 2001, and the department's rules of procedure.
