Section 26.11 - Statutory and Constitutional Limits(a) A goal or policy may not require an agency or subdivision to perform an action that would exceed the constitutional or statutory authority of the agency or subdivision to which the goal or policy applies.(b) The requirements of this chapter may not be applied in a manner that would result in the taking, damage, or destruction of property without adequate compensation.(c) Nothing in these rules shall be construed as providing or allowing for the development of special area management plans, including a plan for an area designated under a national estuary program.31 Tex.
