Section 352.451 - Public Meeting(a) The owner or operator under this chapter and the commission may hold a public meeting under § 55.154 of this title (relating to Public Meetings) in the county in which the facility is located.(b) The commission shall hold a public meeting if a public meeting is required based on the criteria of: (1) § 39.503(e) of this title (relating to Application for Industrial or Hazardous Waste Facility Permit);(2) § 55.154(c) of this title; or(3) § 352.961(c) of this title (relating to Assessment of Corrective Measures).(c) Notice of a public meeting shall be provided in accordance with the procedures contained in § 39.503(e)(6) of this title, and shall be mailed by the chief clerk to the persons listed in § 39.413 of this title (relating to Mailed Notice).(d) The purpose of a public meeting held on an application submitted under this chapter is to provide information and receive public comment. A public meeting held on an application submitted under this chapter is not a contested case hearing under the Texas Administrative Procedure Act.30 Tex. Admin. Code § 352.451
