Section 34.825 - Distribution and Transportation(a) With regard to Fireworks, Title 49 C.F.R., governing the transportation of hazardous materials, is adopted by reference as rules governing the safe distribution and transportation of fireworks as hazardous materials in Texas. These rules are subject to the following explanations and exceptions. (1) When the term "interstate" or "foreign commerce" is used in the federal regulations, it will, for the purpose of such adoption, include all modes of transportation in Texas.(2) When the term "department" is used in the text of the federal regulations as being the Department of Transportation, it shall, for the purpose of such adoption, mean the Texas Department of Insurance.(b) A copy of Title 49 CFR shall be kept available for inspection in the Office of the State Fire Marshal.28 Tex.
