Section 553.501 - Why does HHSC refer a facility to the Office of the Attorney General or local prosecuting authority for a temporary restraining order or an injunction?HHSC refers a facility to the Office of the Attorney General or local prosecuting authority for a temporary restraining order or an injunction when:
(1) a violation creates an immediate threat or threat to the health and safety of residents;(2) a facility is operating without a license; or(3) HHSC is denied entry to a facility that is alleged to be operating without a license.26 Tex. Admin. Code § 553.501
