Section 550.103 - Building Approval
(a) Fire authority. An applicant must receive approval from the local fire authority or, if the jurisdiction does not have a local fire authority, the state fire marshal, for an initial, renewal, change of ownership, relocation, or capacity increase license application. An applicant may submit a license application to HHSC through the online portal before receiving fire authority approval. An applicant must submit to HHSC a copy of a signed and dated written approval for occupancy by the local fire authority or state fire marshal that describes the center by name and address by uploading a copy through the online portal.
(b) Local health authority. An applicant for an initial, change of ownership, relocation, or capacity increase license must submit to HHSC, by uploading through the online portal, a copy of a dated written notification to the local health authority that the applicant is submitting a license application to HHSC. A local health authority may provide an evaluation to HHSC regarding the status of the center's compliance with local codes, ordinances, or regulations. The local health authority may also recommend that HHSC issue or deny a license to the center, but HHSC makes the final decision regarding licensure of the center.
