Section 279.77 - System Checks(a) Purpose. The purpose of a system check is to ensure:(1) that an individual can successfully make an alarm call; and(2) that the equipment is working properly.(b) Conducting a system check.(1) A provider must conduct a system check at least once during each calendar month.(2) The system check must be conducted during normal working hours or as negotiated with the individual.(3) A provider must document a completed system check. The documentation must include the date and time of the completed system check and confirm that the individual was contacted.(c) Failure to complete a system check.(1) When a system check failure occurs, a provider must attempt to complete the system check a total of three times during the calendar month. The attempts must occur on three different days.(2) If a provider is unable to complete a successful system check after three attempts and does not have a documented reason why the system checks have not been completed, the provider must ask a responder to attempt to find out why the individual is unable to complete the system check.(3) If a provider is unable to complete a system check during a calendar month, the provider must provide written notification to the case manager by the 15th day of the month after the system check was due. The written notification must include:(A) the date and time of each attempted system check;(B) the date and time of each attempt to contact a responder other than public service personnel; and(C) the reason the individual was unable to participate, if known.(d) If a provider is unable to complete a system check due to equipment failure, the provider must replace the equipment as described in §52.411(a)(2) of this chapter (relating to Equipment Maintenance).26 Tex.
