Section 12.504 - Topsoil: General Requirements(a) Before disturbance of areas affected by surface operations, topsoil and subsoils to be saved under § RSA 12.505 of this title (relating to Topsoil: Removal) shall be separately removed and segregated from other material.(b) After removal, topsoil shall be immediately redistributed in accordance with § RSA 12.507 of this title (relating to Topsoil: Redistribution), stockpiled pending redistribution under § RSA 12.506 of this title (relating to Topsoil: Storage), or if the permittee can demonstrate that an alternative procedure will provide equal or more protection for the topsoil, the Commission, may, on a case-by-case basis, approve an alternative.16 Tex.
