Section 321.15 - Noncompliance; Failure to Perform(a) A grant recipient shall forfeit up to the amount of the grant funds received, or return previously awarded funds, if the commission, in its sole discretion, determines the grant recipient has failed to perform, in material respect, the obligations established in the grant agreement. The commission may make such a determination at any time during the grant agreement. The commission, in its sole discretion, shall determine the amount forfeited.(b) A failure to perform resulting in forfeiture of grant funds may be cause for the commission to bar an applicant from future consideration for grant funds under this program.10 Tex.
