Section 1660-01-35-.06 - DOCKS
(1) Docks on Lake Halford
(a) All persons desiring docks must submit a written application to the TWRA Lake Manager and must receive written permission prior to any construction of the dock.
(b) Submitted dock plans shall include a drawing.
(c) Docks are allowed and will only be approved if they do not impede or present a hazard to boat traffic and meet all other guidelines and requirements as described herein.
(d) Fees for docks are as follows:
1. Landowner fee - One-time fee - $5,000.00
2. Community dock - One-time fee - ($5,000.00 x number of slips)
(e) A denial of a dock permit by the TWRA Lake Manager may be appealed, in writing, to the Executive Director as provided in relevant provisions of Tenn. Code Ann. §§ 4-5-301 et seq.
(2) General dock rules are as follows:
(a) Only one dock shall be permitted per waterfront lot, and no dock shall have more than two slips and two personal watercraft platforms.
(b) Private boat ramps are prohibited.
(c) Boat houses are prohibited.
(d) Docks shall not extend more than 25 feet into the water at normal lake level. Docks constructed in coves shall not extend more than one-third the distance to the opposite shore or 25 feet into the water, whichever is shorter. Any requests for more than 25 feet shall be considered individually by the TWRA.
(e) No docks shall be located within 15 feet from any neighbor's property line. Where this density requirement cannot be met, only community docks will be allowed. This would require waterfront lots to contain a minimum of 100 feet of shoreline if a dock is desired.
(f) Boat lifts and hoists shall be placed adjacent to or enclosed within a dock with a maximum of two boat lifts and hoists per dock.
(g) Boat lifts and hoists not placed adjacent to or enclosed within a dock shall be considered a dock and an additional dock will not be permitted.
(h) All docks shall be maintained and kept in good repair at the expense of the permittee. A new permit is not required for maintenance of docks provided that docks shall be returned to the originally permitted condition.
(3) Dock construction shall be consistent with the following:
(a) Wooden or metal-framed floating docks are preferred. Recycled plastic wood products are permitted. Only one dock per waterfront lot is permitted.
(b) Styrofoam encased in plastic (encapsulated foam) is required. Barrels are strictly prohibited.
(c) Permanent piers or pilings are discouraged. If pilings are necessary; they must be at least four inches (4") in diameter. Anchoring devices may only be used directly beneath the dock and must not present a hazard to boaters or swimmers
(d) The conversion of an uncovered dock to a covered dock is allowed with written permission from the TWRA Lake Manager.
(e) Dock bumpers can be a fire hose or commercial bumper material. No cut or uncut tires are allowed.
(f) Carpeting is permitted only on the top of the dock.
