Section 1220-01-02-.19 - STAYS(1) Any petition for stay, filed pursuant to T.C.A. § 4-5-316, shall state the grounds therefor with reasonable particularity; may be supported by a brief, affidavit or other supporting evidentiary materials; and shall be served on all parties of record.(2) Any party opposing a stay may file a brief in opposition within ten (10) days after the service of the petition for stay.(3) In deciding whether to grant a stay, the Authority shall consider and give appropriate weight to:(a) the likelihood of the success of the petitioner on appeal;(b) the hardship or injury which may be imposed on the petitioner if a stay is not granted;(c) the hardship or injury which may be imposed on others if a stay is granted; andTenn.
