Section 0940-05-42-.03 - LICENSING PROCEDURES(1) When making application for a new license, the applicant shall submit an application on a form provided by the department along with a copy of the Certificate of Need (CON) issued by the Tennessee Health Services Development Agency or any other applicable state agency. Any condition placed on the CON will also be placed on the license.(2) The written application for operation of an OTP shall be filed simultaneously with the Federal Substance Abuse and Mental Health Service Administration (SAMHSA) and the DEA, and/or any other applicable federal agencies.(3) Service recipients shall not be admitted to the OTP until a license has been issued.Tenn.
