Section 0780-05-09-.12 - FAILURE TO MAINTAIN CEMETERY GROUNDS(1) Any of the following conditions constitutes failure to maintain cemetery grounds: (a) an accumulation of weeds, trash, junk, or filth;(b) any unsafe or unsanitary condition(s);(c) failure to perform any other maintenance obligation created by contract.(2) In determining the amount of any civil penalty, the Commissioner, in addition to those factors in 0780-5-9-.24(3), may consider the following: (a) the reason for the cemetery owner's failure to maintain cemetery grounds;(b) prior instances of the cemetery owner's failure to maintain cemetery grounds;(c) the degree of any condition listed in paragraph (1).Tenn.
