Section 0780-05-02-.14 - WITHDRAWAL OF CERTIFICATION(1) The Commissioner may withdraw the certification of a trainer if, after reasonable notice and opportunity for hearing, the Commissioner finds that such trainer: (a) Has violated any provision of the Act or this chapter;(b) Has become certified through fraud or misrepresentation;(c) Has falsified any statement or record required to be submitted or kept hereunder;(d) Has been convicted by a court of competent jurisdiction of a felony or a misdemeanor, if the Commissioner finds that such conviction reflects unfavorably on the trainer's fitness for certification; or(e) Is demonstrably incompetent to conduct the training required by the Act.(2) If an individual wishes to terminate his status as a certified trainer, he shall notify the Commissioner in writing. The notice shall include the effective date of the desired termination, and shall be accompanied by the certified trainer's original certificate.(3) A withdrawal of certification under this rule shall not affect the creditability of any hours of training satisfactorily completed by a student prior to the effective date of such withdrawal.Tenn.
