Section 0780-01-83-.12 - EXAMINATIONS AND INVESTIGATIONS(1) The Commissioner has the authority to examine the affairs of any Employer that has applied for or received a Certificate of Authority under this Chapter in order to determine the financial condition of the arrangement or to determine whether the arrangement is in compliance with all insurance laws and regulations applicable to it. Such examinations shall be conducted when ever deemed necessary but no less than once every five (5) years, and all expenses of such examinations shall be assessed against the Employer, including the costs of contract examiners or specialists.(2) The Commissioner has the authority to investigate the affairs of any Employer that self-insures its workers' compensation liabilities in this state in order to determine whether such person is in violation of the Tennessee Insurance Law or this Chapter.Tenn.
