Section 0720-35-.11 - RECORDS AND REPORTS(1) The agency shall retain legible copies of the following records and reports for thirty-six (36) months following their issuance. They shall be maintained in a single file and shall be made available for inspection during normal business hours to any person who requests to view them:(a) Department licensure and fire safety inspections and surveys;(b) Centers for Medicare and Medicaid Services (CMS) surveys and inspections, if any;(c) Orders of the Commissioner or Board, if any; and(d) Comptroller of the Treasury's audit report and finding, if any.(2) The agency providing professional support services shall report all incidents of abuse, neglect, and misappropriation to the Department of Health in accordance with T.C.A. § 68- 11-211.(3) The agency providing professional support services shall report the following incidents to the Department of Health in accordance with T.C.A. § 68-11-211. (a) Strike by staff at the facility;(b) External disasters impacting the facility;(c) Disruption of any service vital to the continued safe operation of the home care organization providing professional support services or to the health and safety of its consumers and personnel; and(d) Fires at the home care organization providing professional support services that disrupt the provision of consumer services or cause harm to the consumers or staff, or that are reported by the facility to any entity, including but not limited to a fire department charged with preventing fires.Tenn.
