Section 0400-20-05-.127 - DISPOSAL OF CERTAIN BYPRODUCT MATERIAL(1) Licensed material as defined in subparagraphs (c) and (d) of the definition of Byproduct material set forth in Rule 0400-20-05-.32 may be disposed of in accordance with Chapter 0400-20-05, even though it is not defined as low-level radioactive waste. Therefore, any licensed byproduct material being disposed of at a facility, or transferred for ultimate disposal at a facility licensed under Chapter 0400-20-11, must meet the requirements of Rule 0400-20-05-.125.(2) A licensee may dispose of byproduct material, as defined in subparagraphs (c) and (d) of the definition of Byproduct material set forth in Rule 0400-20-05-.32, at a disposal facility authorized to dispose of such material in accordance with any Federal or State solid or hazardous waste law, including the Solid Waste Disposal Act, as authorized under the Energy Policy Act of 2005.Tenn.
