Section 0240-07-04-.06 - APPEAL OF DECISION(1) The student or faculty member may appeal the Committee's decision to the Provost within five (5) business days of receipt of the decision.(2) An appeal must be submitted in writing and may only be filed based on one (1) or both of the following conditions: (a) An error in procedural due process that prejudiced the Committee to the extent that the student was denied a fundamentally fair hearing as a result of the error; and/or(b) The emergence of new evidence that could not have been previously discovered by the exercise of due diligence and which, had it been presented at the initial hearing, would have substantially affected the decision of the Committee.(3) The Provost may: (b) Reverse the decision in whole or in part; or(c) Return the matter to the Director or Committee for reconsideration of the sanction.(4) The decision of the Provost is final.Tenn.
