Section 74:52:06:03 - Secondary treatmentThe following limitations describe the minimum level of effluent quality attainable by secondary treatment:
(1) The BOD5 30-day average shall not exceed 30 mg/L, the BOD5 seven-day average shall not exceed 45 mg/L, and the BOD5 30-day average percent removal shall not be less than 85 percent;(2) At the option of the permitting authority, in lieu of the parameter BOD5 at the levels of the effluent quality specified in subdivision (1) of this section, the parameter CBOD5 may be substituted provided that the following conditions are met:(a) The CBOD5 30-day average shall not exceed 25 mg/L;(b) The CBOD5 seven-day average shall not exceed 40 mg/L; and(c) The CBOD5 30-day average percent removal shall not be less than 85 percent;(3) The TSS 30-day average shall not exceed 30 mg/L, the TSS seven-day average shall not exceed 45 mg/L, and the 30-day removal shall not be less than 85 percent;(4) The effluent values for pH shall be maintained within the limits of 6.0 to 9.0 unless the publicly owned treatment works demonstrates that:(a) Inorganic chemicals are not added to the waste stream as part of the treatment process; and(b) Contributions from industrial sources do not cause the pH of the effluent to be less than 6.0 or greater than 9.0.S.D.
