Section 74:52:03:15 - Calculation of production-based limits

Except in the case of POTWs, calculation of any permit limits, standards, or prohibitions which are based on production or another measure of operation shall not be based on the design production capacity but on a reasonable measure of actual production of the facility. For new sources or new dischargers, actual production shall be estimated using projected production at the time period of the calculated permit limits.
