The standards of performance for municipal solid waste landfills that commenced construction, reconstruction, or modification after July 17, 2014, are those in 40 C.F.R. § 60 Subpart XXX (July 1, 2018). Physical or operational changes made to existing municipal solid waste landfills solely to comply with §§ 74:36:07:94 to 74:36:07:145, inclusive, or activities required by or conducted pursuant to a CERCLA, RCRA, or state remedial action are not considered construction, reconstruction, or modification for purposes of this section.
