Section 74:36:05:22 - Department failure to meet EPA objection deadline

If the department fails to submit a revised proposed Part 70 operating permit or justification in accordance with § 74:36:05:21.01 to EPA to meet the objection within 90 days after its receipt, responsibility for issuing or denying the final permit rests with EPA.
