Section 70:03:01:112 - Rear-mounted forklift permit - Limitations and requirementsA rear-mounted forklift permit authorizes a mounted forklift to be hauled as part of an overlength vehicle if the vehicle and mounted forklift meet all of the following conditions:
(1) The forklift is designed and intended to be carried on the rear of the vehicle;(2) The forklift is used or intended to be used to load or unload a commodity on or off the vehicle;(3) The forklift does not extend more than seven feet beyond the rear of the vehicle;(4) The forklift is properly lighted, as provided in SDCL 32-17-8, 32-17-8.1, and 32-17-18, and the forklift tail lamps are equally offset from the centerline of the vehicle. If the tail lamps of the forklift are spaced less than 48 inches apart, when measured from center to center, the tail lamps of the vehicle must be plainly visible to the rear. The forklift must also be lighted as provided for in SDCL 32-17-14 and 32-17-15;(5) The forklift is securely fastened to the vehicle using a factory-approved mounting system consisting of substantial chains, cables, or equivalent means of attachment, that can reasonably prevent the forklift from accidentally detaching from the vehicle;(6) Straight trucks may not exceed a maximum loaded length of 45 feet; semitrailer units may not exceed a maximum loaded length of 57 feet; and in no case may a semitrailer exceed 53 feet;(7) The maximum width allowed under this permit may not exceed the provisions of SDCL 32-22-3;(8) The vehicle must meet conspicuity requirements set forth under Chapter 49 of the Code of Federal Regulations part 393.13 as of January 1, 2004; and(9) The vertical distance between the lowest point of the forklift, including the tire within 12 inches of the rear extremity of the forklift, and the ground may not exceed 22 inches. If the mounted forklift is properly lighted as required by subdivision (4) in this section during daylight hours, then the forklift does not need to meet the flagging requirements provided for in SDCL 32-22-6.
