Section 68:03:01:05 - Ongoing reporting requirements - Revocation of designation

No less often than biennially, the applicant shall certify to the GOED in writing that none of the material facts set out in its initial application have changed. If any material change occurs, the applicant shall, within 30 days of a material change, notify the GOED, in writing, of any such change. If the applicant fails to submit a report or the site is no longer eligible for certification, the GOED may revoke the certification after notice and a hearing conducted pursuant to the provisions of SDCL chapter 1-26.
