Section 67:42:17:21 - Supervision, ratios and group size - Family day care

Family day care providers may care for up to twelve children in their home. A family day care program provider shall supervise children by hearing or seeing children and be close enough to intervene at all times. The following ratios are required:

(1) No more than four of the twelve children can be under the age of two years with only one provider present, and no more than three of the four children can be under the age of one.
(2) If a family day care assistant is present in the home, no more than eight of the twelve children can be under the age of two.

A family day care provider's own children under the age of six are included in the total capacity and ratio.
