The department may not deny an Aid to Families With Dependent Children payment because of the condition of the home where a child resides unless a court of competent jurisdiction has declared the home unsuitable and provision is made for the care and assistance of the child. When the department has reason to believe that the home where a relative and child receiving aid reside is unsuitable because of the neglect, abuse, or exploitation of the child, it will bring the condition to the attention of the Division of Child Protection Services.
