If the employee fails to appear in person or by counsel at the time and place set for hearing, the commission shall presume that the employee has waived the right to further hearing and the commission may dismiss the appeal. The commissioner may reschedule the hearing upon presentation by the employee or counsel of written evidence of extenuating circumstances that prevented the appearance of the employee.
