Section 46:30:05:09 - Requirements of fair hearing procedure

Fair hearing procedure shall include an opportunity to develop the facts relevant to points in issue; confrontation and cross-examination of witnesses under oath; objection to admission or exclusion of evidence; rebuttal of evidence presented; introduction of exhibits and documents as evidence; examination, upon request, of all exhibits and documents offered or received as evidence either at or prior to the hearing; and making available any relevant materials or statements on the issue.
