The commission may approve, deny, or approve subject to changes in the operation plan any application for licensure as a "multi-jurisdictional totalizator hub", if the commission deems the applicant suitable to hold the license and considers the level of technology and operational issues and practices proposed in the operation plan to be in the publics best interest. The applicant has the burden of proving its qualifications and suitability, as well as the quality of the operation plan, by clear and convincing evidence, to the satisfaction of the commission.
