Section 20:04:21:42 - Penalty for owner's failure to pay jockey fee

The owner of a horse which is prevented from starting in a race because of the owner's failure to pay the jockey fee for that race or because of arrears against the owner or his horse is liable for any declaration fee, and he and his horse shall be suspended until the fees are paid.

Declaratory Ruling: A state racing steward is permitted to authorize a horse race to be run prior to the payment of jockey fees if payment of the jockey fees is appropriately guaranteed before the race. South Dakota Commission on Gaming Declaratory Ruling dated November 13, 1991.
