Section 20:04:01:40 - Preparation of exclusion list

The commission may establish a list of persons to be excluded or ejected from pari-mutuel wagering facilities in the state.

In making the determination of persons to be excluded, the commission may consult with gaming regulators in other states and countries and law enforcement agencies. The commission may exclude any person in the judgment of the commission who:

(1) Has been ordered excluded or barred from any racetrack, a pari-mutuel, or legalized gaming facility in the United States;

(2) Has been convicted of violating the racing or gaming laws of any state or any tribal government;

(3) Has a notorious or unsavory reputation that would adversely affect public confidence and trust that the pari-mutuel industry is free from criminal or corrupt influence;

(4) Has been determined to pose a threat to the state of South Dakota or to the pari-mutuel racing industry; or

(5) Has failed to disclose an interest in the ownership or management of any facility or enterprise for which the person must obtain a license from or make a disclosure to the commission.
