Section 61-88.1 - Federal requirements(a) Section505(2)(D)(2)(D) of the Social Security Act as amended effective October 1, 1981, requires that if a State imposes any charges for the provision of health services assisted by the State under Title V of the Act, such charges (i) will be pursuant to a public schedule of charges, (ii) will not be imposed with respect to services provided to low income mothers or children, and (iii) will be adjusted to reflect the income, resources, and family size of the individual provided the services.(b) Section501(b)(2)(b)(2) of the Social Security Act as amended effective October 1, 1981, defines "low income" to mean, with respect to an individual or a family, such an individual or family with an income determined to be below the nonfarm income official poverty line defined by the Office of Management and Budget and revised annually in accordance with section624 of the Economic Opportunity Act of 1964.S.C.
