Section 815-RICR-00-00-1.13 - PetitionsA. General 1. Petitions filed under any statute or other authority delegated to the Division shall be in writing, shall state clearly and concisely the petitioner's interest in the subject matter, the facts relied upon, and the object of the petition, and shall cite by appropriate reference the statutory provision or other authority relied upon in the filing. Four (4) legible copies shall be filed with the original.B. Petitions for Issuance, Amendment, Waiver or Repeal of Rules 1. A petition for the issuance, amendment, waiver or repeal of a rule by the Division shall, in addition to stating the specific rule, amendment, waiver, or repeal requested, state in detail with citations to appropriate references, the reasons for the requested action. Four (4) legible copies shall be filed with the original.2. Upon submission of such a petition, the Division will within thirty (30) calendar days, either deny the petition in writing or initiate rulemaking procedures in accordance with R.I. Gen. Laws § 42-35-3.C. Petitions for Declaratory Judgment 1. In addition to the requirements of subsection (a) above, a petition for declaratory judgment pursuant to R.I. Gen. Laws § 42-35-8 shall set forth the rule or statutory provision in question and shall state in detail, with appropriate citations, whether the rule or provision should or should not apply.815 R.I.
