Section 280-RICR-30-20-1.13 - Show Cause Hearings & FinesA. Show Cause Hearings1. If the Department has reason to believe that any person, firm, corporation or association is: Violating the provisions of these rules or R.I. Gen. Laws Chapter 31-5 or 31-5.1, the Department may issue its order to such person, firm, corporation or association commanding them to appear at a hearing to be held not sooner than ten (10) days after issuance of said order to show cause why the Department should not issue an order to said person, firm, corporation or association to cease and desist from such violation of the provisions of this chapter. If upon such hearing the Hearing Board shall be satisfied that such person is in fact violating any provision of this chapter, then it shall order such person, in writing, to cease and desist from such violation or may in its discretion suspend or revoke the license. In the case of suspension or revocation, the Department must have complied with the notice provisions of § 1.12(B) of this Part. All such hearings shall be conducted in accordance with the Administrative Procedures Act, R.I. Gen. Laws Chapter 42-35. If such person shall thereafter fail to comply with the order of the Department, the Superior Court for the State of Rhode Island shall have jurisdiction upon the complaint of the Department to restrain and enjoin such person from violating this chapter.B. Any licensee or other person dissatisfied by any order of the Hearing Board or Department shall within thirty (30) days after receiving the order, file a petition for review in Superior Court.280 R.I.
