Section 250-RICR-150-05-2.3 - ApplicationA. The terms and provisions of these Rules and Regulations shall be liberally construed to permit the Department to effectuate the purposes of state law, goals and policies.B. These Rules and Regulations apply to all aspects of dredging proposed in marine waters of the State of Rhode Island, and govern the issuance of all Department approvals required under state law and delegated federal law, including determinations relating to the protection of water quality, wetlands and fish and wildlife; and, to the extent applicable, the management of solid or hazardous waste. If the project involves a significant alteration to freshwater wetlands, then § 2.9(C)(4) of this Part applies.C. These Rules and Regulations shall be implemented in accordance with a written protocol, adopted jointly by the Department and the Council for purposes of further coordinating and streamlining the interagency review of applications. The Department and the Council may update the protocol from time to time for said purposes, and shall provide a copy of the most recent version with their application materials.250 R.I.
