Section 250-RICR-120-05-39.8 - Pre-Construction Requirements and Siting Criteria39.8.1Pre-Construction RequirementsAll HMIWI, must comply with all construction permit requirements in Part 9 of this Subchapter (Air Pollution Control Permits).
39.8.2Siting CriteriaA. The owner or operator of an affected facility shall prepare an analysis of the impacts of the affected facility. The analysis shall consider air pollution control alternatives that minimize, to the maximum extent practicable, potential risks to public health or the environment. In considering such alternatives, the analysis may consider costs, energy impacts, non-air environmental impacts, or any other factors related to the practicability of the alternatives.B. The analyses of facility impacts prepared to comply with State, local, or other Federal regulatory requirements may be used to satisfy the requirements of this section, as long as they include the consideration of air pollution control alternatives specified in §39.8.2(A) of this Part.C. The owner or operator of the affected facility shall complete and submit the siting requirements of this section as required under § 39.13(A)(3) of this Part.250 R.I. Code R. 250-RICR-120-05-39.8
