Section 250-RICR-100-00-7.13 - Food, Beverage, VendingA. No person shall possess, drink, sell or offer for sale any alcoholic beverages except as follows:1. Alcoholic beverages can be served and/or sold at events at Fort Adams State Park through a License Agreement approved by the Director of RIDEM or an authorized representative and the State Properties Committee.2. Alcoholic beverages can be served and/or sold at designated locations at mission related fundraising events hosted by the Beavertail Lighthouse Museum Association at Beavertail State Park and by Coggeshall Farm Museum/ Old Sturbridge Village at Colt State Park through a License Agreement approved by the Director of RIDEM, or an authorized representative, and the State Properties Committee. Any event hosted by either associated non-profit will be permitted to take place within the portion of the Park identified under their respective Memorandum of Understanding or Lease, and any profits raised from these fundraising events must be used by the associated non-profit for programming, restoration and/or improvements on that premises or at the associated Park.3. Alcoholic beverages can be served at a State beach through a License Agreement approved by the Director of RIDEM or an authorized representative and the State Properties Committee. License Agreements shall be reserved only to State beaches where the average annual attendance for the previous three (3) years exceeds three hundred thousand (300,000) visitors.B. No person shall offer for sale or attempt to sell any goods or services on any Public Reservation governed by these Regulations without official written permission from the Director of the RIDEM or his or her authorized representative.C. No person shall sell, offer for sale, or attempt to sell any ticket, privilege, or license of admission to an entertainment event, including, but not limited to, any place of public amusement, arena, stadium, theatre, performance, sport, exhibition, or athletic contest conducted in any part of a Public Reservation governed by these Rules and Regulations. 1 Any person found to be in violation of § 7.13(A)(3) of this Part at the discretion of the Chief of the RIDEM Division of Law Enforcement or his or her designee shall either be prosecuted for a violation of R.I. Gen. Laws § 5-22-26 or may be issued a citation pursuant to R.I. Gen. Laws § 8-8.2.2. Any person against whom the prosecution for a violation of R.I. Gen. Laws § 5-22-26 has been instituted or who has been issued a citation pursuant to R.I. Gen. Laws § 8-8.2 for violation of § 7.13(A)(3) of this Part, shall be immediately removed from, and barred from re-entering, the Public Reservation in which entertainment event is being conducted for a period of one (1) year from the date of the person's removal from the Public Reservation.250 R.I.
