Section 6100.441 - Request for and approval of changes(a) A provider shall submit a written request to the Department on a form specified by the Department and receive written approval from the Department prior to increasing or decreasing the Department-approved program capacity of a service location.(b) To receive written approval from the Department as specified in subsection (a), the provider shall submit a description of the following:(1) The circumstances surrounding the change.(2) How the change will meet the service location size, staffing patterns, assessed needs and outcomes for the individuals.(c) The program capacity, as specified in writing by the Department, may not be exceeded. Additional individuals funded through any funding source, including private-pay, may not be provided services in the service location to exceed the Department-approved program capacity.(d) A copy of the written request specified in subsections (a) and (b) shall be provided to the affected individuals, and persons designated by the individuals, prior to the submission to the Department.(e) A copy of the Department's response to the written request specified in subsections (a) and (b) shall be provided to the affected individuals, and persons designated by the individuals, within 7 days following the receipt of the Department's response.
