Section 140.31 - Income eligibility limitations(a) Net family income after applicable deductions and disregards cannot exceed the following: (1) The percentage of the Federal Poverty Income Guidelines (FPIGs) for the appropriate family size for mandatory coverage set forth in section 1902 of the Social Security Act (42 U.S.C.A. § 1396a).(2) The percentage of the FPIGs for the appropriate family size for the optional coverage established in § 140.1(b) (relating to policy on healthy beginnings) for pregnant women and infants under 1 year of age.(b) The unborn child is counted as a family member when determining eligibility of the pregnant woman, including her presumptive eligibility.The provisions of this § 140.31 adopted September 2, 1988, effective 10/1/1988, 18 Pa.B. 4004; amended September 18, 1992, effective upon publication for the OBRA 1989 requirements retroactive to April 1, 1990, and effective 7/1/1991, for OBRA 1990 requirements, 22 Pa.B. 4694; amended April 2, 1993, effective upon publication and applies retroactively to January 1, 1993, 23 Pa.B. 1562.
