Section 41.44 - Transfer of petition for relief(a) If a provider filed a petition for relief prior to the date of an agency action in which it has sought relief in connection with or relating to that agency action, the provider may file a motion to have the petition for relief transferred to the Bureau and deemed a request for hearing. The motion shall be filed within the time allowed for the filing of a request for a hearing specified in § 41.32(a) (relating to timeliness and perfection of requests for hearing).(b) Subsection (a) supersedes 1 Pa. Code §35.17 (relating to petitions generally) to the extent that an appealable agency action is involved.
