Section 81.231 - Listing for hearing(a)Noncapital cases. Applications are subject to merit review by the Board to determine if a public hearing will be granted. For prisoners serving life sentences or sentences for crimes of violence, a vote by a majority of the Board is required to grant a public hearing. In all other cases, except capital cases, two votes are required for a public hearing to be granted.(b)Capital cases. Applicants seeking commutation of a death sentence will automatically receive a public hearing. Applications for commutation of death sentences shall be filed with the Board within 10 days of the Governor's issuance of a warrant specifying a week for execution.The provisions of this §81.231 adopted April 18, 1997, effective 4/19/1997, 27 Pa.B. 1929.
