Section 95.35 - New matter in the answer(a) Affirmative defenses, including but not limited to the jurisdiction of the Board and statute of limitations, shall be pleaded under the heading of new matter in the answer.(b) Allegations of new matter in the answer shall be deemed denied without the necessity of a reply.The provisions of this § 95.35 adopted October 23, 1970, effective 10/24/1970, 1 Pa.B. 419.
