Section 273.277 - Departmental notice and remedial actionThe operator shall immediately notify the Department and describe remedial steps to be taken if:
(1) Operation of the treatment facilities in accordance with the approved plan cannot prevent violation of the terms of its permits, The Clean Streams Law (35 P. S. §§ 691.1-691.1001) or regulations thereunder.(2) The facility is generating a quality or quantity of leachate that exceeds the design capacity of the onsite pretreatment system.(3) The contractual agreement for leachate treatment by an offsite treatment system is breached or expired.(4) The quality or quantity of solid waste being disposed at the site changes from that set forth in the permit.The provisions of this § 273.277 amended December 22, 2000, effective 12/23/2000, 30 Pa.B. 6685.
