(a)Duration of covenant. An environmental covenant is perpetual except as provided under section 6509 of UECA (relating to duration).(b)Eminent domain. When the Department is the agency referenced in section 6509(a)(5) of UECA, notice and request for consent must be made in writing and submitted to the Department at least 30 days prior to commencement of the eminent domain proceeding.(c)Judicial termination or amendment. Where the Department is the agency referenced in section 6509(b) of UECA, the notice and request for determination must be made in writing and submitted to the Department at least 90 days prior to commencement of the judicial proceeding.
