Section 287.118 - Departmental responsibilities(a) Nothing in §§ 287.111-287.117 prevents the Department from taking action necessary or appropriate to enforce the act, the environmental protection acts or the regulations promulgated thereunder, to protect public health, safety, welfare or the environment, or to prevent or abate a public nuisance.(b) Notwithstanding any deadline in §§ 287.111-287.117, the Department may require an operator to conduct groundwater monitoring or another activity required by this article that the Department believes is necessary or useful to determine the effect or potential effect of a residual waste processing or disposal facility on public health, safety, welfare or the environment.(c) Nothing in §§ 287.111-287.117, or a permit issued by the Department to a facility subject to §§ 287.111-287.117, relieves a facility of its responsibility to secure a plan approval and operating permit under the Air Pollution Control Act (35 P. S. §§ 4001-4015) and Subpart C, Article III (relating to air resources), or to comply with a requirement of another environmental protection act or the regulations promulgated thereunder.
