Section 130.607 - Variance orders(a) A variance order will specify a final compliance date by which the requirements of § 130.603 (relating to standards) must be achieved. A variance order will contain a condition that specifies increments of progress necessary to assure timely compliance and other conditions that the Department determines to be necessary, in consideration of the testimony received at the public hearing held in accordance with § 130.610 (relating to public hearings), written comments and other information available to the Department.(b) The Department will submit each variance order to the United States Environmental Protection Agency for approval as a State Implementation Plan revision.
