Section 127.423 - Notice of basis for certain operating permit decisions(a) When the Department refuses to grant an approval or to issue or reissue a permit or to terminate, modify, suspend or revoke an operating permit already issued, the action will be in the form of a written notice to the person affected informing the person of the action taken by the Department and setting forth in the notice a full and complete statement of the reasons for the action.(b) The notice required by subsection (a) will be served upon the person affected either by hand delivery or by certified mail return receipt requested.(c) The action set forth in the notice shall be final and not subject to review unless, within 30 days of the service of the notice, a person affected thereby appeals to the EHB setting forth the grounds relied upon.(d) The EHB will issue an adjudication affirming, modifying or overruling the action of the Department.
